Terms and Conditions  

 

 

These Terms and Conditions become effective on payment of a booking deposit.

 

 

1. Confirming the booking

I) A booking is only confirmed when the booking deposit has been received and cleared.

II) All bookings take effect immediately upon receipt of deposit.

III) Payment of deposit by any method is deemed as the client’s acknowledgments and acceptance of these Terms and Conditions.

 

 

2. Payment of fees

I) The agreed booking deposit is due strictly within 14 days of initiating the booking.

II) Unless otherwise agreed in advance of the event by ‘Bromley Wedding DJ’, the balance is payable to the DJ in cash on the day of the event prior to the DJ starting.

III) Clients wishing to pay the outstanding balance by other methods (cheque/paypal/bank transfer) must ensure that this is agreed with ‘Bromley Wedding DJ’ and that ‘Bromley Wedding DJ’ in receipt of the full balance 10 working days prior to the event.

 

 

3. Cancellations

The terms of this agreement do not allow for cancellation other than by mutual consent of both parties and confirmed in writing.

Cancellation by the client:

I) In the event that the client cancels the booking, the client agrees to inform ‘Bromley Wedding DJ’ immediately.

II) Any cancellations made at least 90 days prior to the date of the event will only forfeit the deposit paid.

III) If you fail to cancel your booking before 90 days prior to the event you will be charged:

Within 60 – 89 days of your event date: Booking deposit + 25% of the outstanding balance will be payable by the client to ‘Bromley Wedding DJ’ within 14 days.

Within 30 – 59 days of your event date: Booking deposit + 50% of the outstanding balance will be payable by the client to ‘Bromley Wedding DJ’ within 14 days.

Within 0 – 29 days of your event date: Booking deposit + 100% of the outstanding balance will be payable by the client to ‘Bromley Wedding DJ’ within 14 days.

Cancellation by ‘Bromley Wedding DJ’:

I) In the very unlikely event that ‘Bromley Wedding DJ’ cancels the booking due to unavoidable circumstances, ‘Bromley Wedding DJ’ agrees to inform the client of the cancellation and make all reasonable attempts to find a suitable replacement DJ of similar standard and style, at no extra cost to the client. Should a suitable replacement not be found, ‘Bromley Wedding DJ’ agrees to refund the client their deposit plus any other booking fees already paid in advance.

 

 

4. Changes on the day

I) Where possible, changes to the schedule which are unavoidable on the day of the event should first be discussed & agreed with ‘Bromley Wedding DJ’. Should this not be possible, changes are to be agreed between the client and the DJ prior to their performance.

II) Any changes will be subject to these terms and conditions.

III) Changes negotiated between the client and the DJ on the day of the event and any extra fee’s are agreed upon the client must pay these extra fee’s along with the remaining balance of the booking fee.

IV)In the event that the DJ’s performance is delayed due to unavoidable circumstances, liability is limited to providing the client with performance time equal to time lacking or a discount/refund at a pro rata rate based on the time of commencement of music.

V) Any delayed set up time or subsequent delayed start time due to the overrun of any prior proceedings or of situations being outside of ‘Bromley Wedding DJ’s' control will not warrant any extension of the stated finish time or any fee reduction. However, at the sole discretion of the DJ and with the permission of the venue management, an extension of these performing times may be made. The DJ will charge an additional fee. This fee must be paid in cash to the DJ before any extra time commences.

VI) The client must supply a minimum of one hour to enter a venue and set up prior to the start time and also a similar time allowance at the end of the night to pack up. This time can be reduced if access is good and the DJ is familiar with the venue.

VII) If access to the venue is difficult e.g. stairs, distance from unloading area etc. The client agrees to provide assistance with getting all of the DJ’s equipment to and from the required area.

 

 

5. ‘Bromley Wedding DJ’ service guarantee

I) The DJ agrees to provide a performance that is to the best of their ability, and reflects fully the likeness of the DJ show, as known to and as advertised to the ‘client’ via pictures, videos, web page etc. The DJ will make every effort to ensure their performance is outstanding, adhere to the client’s wishes within all reasonableness, be polite and courteous with the client, their guests and all venue staff and contractors.

II) The DJ agrees to provide all equipment required to undertake this performance, unless the equipment has been contractually agreed to be provided by the ‘client’ or a third party.

III) The DJ agrees that their fee is inclusive of all expenses (except those that have been itemised or accounted for separately ), travelling expenses to and from the venue, VAT, tax, N.I. etc and covers any payments whatsoever due to other members.

V) The DJ will not display any conduct deemed anti-social, illegal, nor reflecting badly upon themselves, ‘Bromley Wedding DJ’, or the ‘client’.

VI) The adjustment of the volume and sound level of any equipment shall be as the client reasonably requires whilst working under any restraints that the venue may apply.

 

 

6. Music Requests

I) ‘Bromley Wedding DJ’ will make every reasonable effort to supply and play requests that are advised up to 14 days in advance of the event.

II) The client agrees to provide ‘Bromley Wedding DJ’ with any music that they have requested where ‘Bromley Wedding DJ’ has informed them that he is unable to supply it.

III) The DJ will make reasonable effort to play as many additional requests notified by the client and those canvassed from guests during the evening (unless the client has specified that they do not wish guests to make requests), as they can, however, there is no guarantee that all requests will be played.

IV) The DJ reserves the right to refer any requests of a questionable nature to the client or the venue management.

 

 

7. ‘DJ’ equipment

I) It is agreed by the client and the DJ that the equipment and instruments of the DJ are not available for use by other performers or persons except by specific permission of the DJ.

II) Where permission had been given for use of the DJ’s equipments by others, ‘Bromley Wedding DJ’ will not be responsible for its working order or any problems to other services it may cause.

III) In the very unlikely event the DJ’s performance is delayed or terminated due to major equipment failure i.e. music is unable to be played, liability is limited to providing the client with a pro rata rate discount/refund of the booking fee from the time of termination.

IV) The DJ accepts no liability for minor equipment failure i.e. failure that does not result in termination of music.

V) ‘Bromley Wedding DJ’ accepts no liability for equipment failure/music termination caused by any ‘Sound Limiter’ shutting off the supply of electricity to the DJ’s equipment.

VI) All equipment is subject to availability and used according to the rules of the venue and health and safety where we see fit.

VII) The client must seek explicit permission from the venue to enable the DJ to use the haze machine. This equipment will not be used unless ‘Bromley Wedding DJ’ has been notified in advance of the event that permission has been granted.

VIII) The client must ensure protection of the DJ’s equipment from adverse weather conditions, where the DJ’s location is not inside e.g. gardens, marquees etc. The client will be fully liable for any damage to equipment, caused by adverse weather conditions. Payment for any damaged equipment should be received by ‘Bromley Wedding DJ’ within 7 days of the event.

IX) It is the responsibility of the client to ensure that there is an adequate provision of electrical power within ten metres of the DJ’s set-up point

 

 

8. Withdrawal Of Services

I) In case of verbal and/or physical violence towards the DJ’s or any person/person’s connected with ‘Bromley Wedding DJ’, the client will be asked to have this/these people removed from the venue. If an agreement regarding this can not be resolved then the services of ‘Bromley Wedding DJ’ will be stopped, and the client will be liable for the remainder of any booking fee’s due.

II) In the case of damage being caused to any equipment (either belonging to contracted to or leased to ‘Bromley Wedding DJ’ by the client or any person/person’s at the event, the service’s of ‘Bromley Wedding DJ’ may be stopped, and the client will be liable for the remainder of any booking fee’s due, and the client will also be fully liable for any damage to equipment, payment for any damaged equipment should be received by ‘Bromley Wedding DJ’ within 7 days of the event.

 

 

9. Force Majeure

In cases of ‘Force Majeure’ (which shall be known as war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, accident, civil commotion, national calamity, order of Government or Local Authority having jurisdiction in the matter, changes in law, foreign government policy, act of God), which are not attributable to any act or failure to take preventive action by the DJ or client, then the DJ or client may cancel this booking without penalty other than loss of deposit.

 

 

10. Complaints Procedure

I) Any issues that arise during the event must be communicated to DJ at the time that they arise in order for the DJ to have an opportunity to solve the issue. The DJ is unable to resolve issues if they are not aware of any situation that may occur during a performance.

II) In the unlikely event that you should feel dissatisfied with any aspect of services provided by ‘Bromley Wedding DJ’ and the issue was not resolved during the event, the client must contact us in writing within 48 hours of the end of the event.

III) ‘Bromley Wedding DJ’ will not enter into any discussions with regards to the individual DJ's presentation style or content as this is a subjective interpretation.

IV) In the unlikely event there is a requirement for reimbursement of fees paid, not covered elsewhere in the Terms and Condition, it is limited to the fee paid.

 

 

11. Photos, Filming, and Testimonials

I) During your event the DJ may take photos or video relevant to the marketing of ‘Bromley Wedding DJ’. These photos or video  may be used on our website or on social networking sites linked to ‘Bromley Wedding DJ’. If you do not want any photos or films of your event to be used for this purpose please inform us within 48 hours of your event.

II) Written feedback that we receive from events may be used for the purpose of marketing ‘Bromley Wedding DJ’. This feedback may appear on our website. If you do not want your feedback to be used for this purpose please inform us at the time of sending it.
